Deposition, Meeting, Arbitration, Conference Scenario

The lawyer or paralegal attends a deposition with their iPad2, however beforehand we both knew in advance that you will have a strong Wi-Fi connection to the Internet.

If you are using your Mac, or PC, if available, use direct fast-cable access, standard ethernet cable.
We will connect and I will see and hear the witness through FaceTime, FuzeMeeting, Skype, your choice of service, and because the witness is always viewable by me we are complying with Rule 30(b)(4) of the Federal Rules of Civil Procedure which also gives counsel wide latitude when litigants are agreeable to stipulating.

You use your favorite trusted court reporter when you are in town, now take him or her with you no matter where you go!  Why not?  It's your client you want to please and they are already happy with your choice of reporter, so if technology is here to get you want you want, start using it.

Usually witnesses like to read their transcripts and provide an errata.  Do that here as well.  Make that a condition to the deposition.

There will be an added affidavit that the witness must present to a notary, a bank officer, for instance, and that affidavit will state, "I hereby swear and sign before a notary, that I have read my deposition in its entirety and this is my sworn testimony save for instances where I believe it is wrong or I want to add or subtract from my testimony as listed in my sworn errata."

This additional affidavit secures the fact that the witness adopts the transcript as their sworn testimony save for the errata which all witnesses are entitled to have.

FURTHER, as insurance not just for Mr. Hubbard but protection for the litigants, a backup digital audio file is preserved and maintained for three months after which time the backup audio is destroyed.
